WASHINGTON D.C. — Independent Women celebrated the successful conclusion of its legal challenge to the Biden administration’s unlawful rewrite of Title IX after the U.S. Court of Appeals for the Eleventh Circuit granted the parties’ motion to dismiss the appeal as moot and vacated the district court’s denial of a preliminary injunction.
Independent Women was a plaintiff in a lawsuit challenging the Biden administration’s attempt to rewrite Title IX by inserting “gender identity” into federal law and dismantling longstanding sex-based protections for women and girls.
After multiple federal courts across the country ruled against the Biden administration’s Title IX rule, intervenors and progressive advocacy groups ultimately abandoned their efforts to continue defending the regulation on appeal. In light of those favorable rulings and the collapse of the underlying rule itself, Independent Women and its co-plaintiffs moved to dismiss the case as moot and requested vacatur of the district court’s earlier preliminary injunction denial. The Eleventh Circuit granted that request, dismissing the appeal as moot and vacating the lower court’s decision.
“This litigation has reached a victorious conclusion,” said Beth Parlato, senior legal counsel for Independent Women’s Law Center. “Courts across the country recognized what the Biden administration refused to admit: Title IX was enacted to protect women and girls on the basis of biological sex, not gender ideology. The attempt to rewrite federal law through executive fiat has failed.”
“This is a victory for women’s single-sex spaces, sports, and the biological definition of sex under Title IX,” Parlato continued. “Countless states, organizations, athletes, parents, and advocates stood together to defend truth, fairness, and equal opportunity for women and girls. Because of those efforts, the Biden administration’s unlawful Title IX rule is buried for good.”
