WASHINGTON, D.C. — After the Obama and Biden administrations encouraged schools to view even basic questions of classroom discipline through the lens of race, the Trump administration is returning schools to true American principles: students should be judged by their behavior and outcomes, not by the color of their skin.

Independent Women applauds the new guidance issued by the U.S. Department of Education directing schools to administer discipline fairly and without favoring or disfavoring students based on race.

Under the previous framework, demographic disparities could be used to establish a civil rights violation even in the absence of an explicitly discriminatory policy or discriminatory intent. According to the Department of Education, previous federal guidance had pressured schools to alter disciplinary procedures in pursuit of racially balanced outcomes.

Inez Stepman, Independent Women senior legal and policy analyst, who has weighed in on this issue extensively over the years, said, “School discipline is yet another area of the law into which the Left has inserted their disastrous ideas about race and disparities, treating every difference in outcomes on a mass level as a matter of presumptive discrimination. In this case, forbidding schools from doling out discipline on the basis of individual behavior rather than with an eye to a kind of racial quota chart has had serious consequences for school safety and the ability of all children to learn in an environment of respect. We applaud the Trump administration for enforcing our civil rights laws fairly and equally, without special favor.”

The department also opened Title VI investigations into school districts in Fayetteville, Arkansas, and Milwaukee, Wisconsin, over allegations that personnel were encouraged or required to consider race when making disciplinary decisions.

Neeraja Deshpande, Independent Women policy analyst, said, “The Trump administration just reversed disastrous policies from the Obama and Biden administrations that de facto banned teachers from giving consequences to disruptive and violent students. This is yet another welcome step from this administration toward returning schools to safety, order, and academic excellence.”

GIVE TEACHERS A BREAK

Independent Women has repeatedly highlighted how misguided government mandates and bureaucratic red tape have stripped teachers of the authority they need to maintain orderly classrooms.

In the report, “Give Teachers A Break: Cutting Red Tape to Unleash the Potential of America’s Great Teachers,” Independent Women documents how deteriorating classroom discipline, ideological mandates, and layers of bureaucracy have made teaching more difficult and learning less effective.

“Give Teachers A Break” calls for restoring teachers’ authority to enforce basic classroom discipline, holding disruptive students accountable, protecting academic standards, and removing government barriers that prevent educators from doing what they entered the profession to do: teach.

Today’s action from the Trump administration is an important step toward that goal. Safe, orderly classrooms require clear rules, empowered teachers, and one standard of behavior for every student—regardless of race.
