WASHINGTON, D.C. — The U.S. Department of Education rescinded six unlawful Biden-era Title IX “resolution agreements” that allowed men to infiltrate women’s sports and spaces. This action marks an important step toward restoring Title IX to its original intent—protecting education-based programs on the basis of biological sex.
For years, schools across the country were pressured to adopt policies based on a misinterpretation of Title IX and at the expense of women’s rights, safety, and privacy. By reversing course, President Donald J. Trump’s Education Department, led by Secretary Linda McMahon, is reaffirming that Title IX is rooted in biological sex and must be enforced accordingly.
Independent Women issued its support for the Trump administration’s continued leadership in holding schools accountable in ensuring clarity and fairness in the application of Title IX under federal law:
Payton McNabb, Independent Women sports ambassador, said: “The Department of Education is right to walk back these backwards ‘resolution agreements,’ which were built on an upside down version of Title IX that even the courts have rejected. Restoring clarity is essential, not just for compliance, but for ensuring that the rights of women and girls are not sidelined in the process.”
Beth Parlato, senior legal counsel for Independent Women’s Law Center, said: “The Department of Education’s action today restores the rule of law to Title IX enforcement. The Biden administration imposed unlawful resolution agreements expanding Title IX beyond its original text and purpose. By rescinding these unlawful mandates, Title IX sex-based protections are safeguarded against unlawful reinterpretations that disregard biological reality and undermine the rights of women and girls.”
Since day one of the Trump administration when the definition of sex was established through executive order, the original intent of Title IX has been upheld, prohibiting discrimination on the basis of sex and safeguarding women’s privacy, safety, and equal opportunity. This additional action provides clarity for educational institutions and school districts, ensuring that enforcement of Title IX aligns with both statutory text and longstanding legal precedent.
