WASHINGTON D.C. Today, Independent Women’s Law Center along with a coalition of 68 other amici filed an amicus brief at the United States Supreme Court in First Choice Women’s Resource Centers v. Platkin.  

In this case, the Attorney General of New Jersey served investigatory subpoenas upon a private, not-for-profit entity, to turn over a massive amount of information, including donor disclosures. The Supreme Court’s grant of certiorari presents a critical opportunity to protect the federal right to stop unconstitutional state official action and to prevent the degrading of protections to donor privacy. 

The brief makes the case that the state’s subpoena for donor disclosure naturally chills the association and speech of potential donors who are concerned about privacy, and thus will also chill the organization’s speech and association. 

Beth Parlato, senior legal advisor for Independent Women’s Law Center, said, “Potential donors of private organizations certainly expect anonymity in making their donation, and their privacy must be protected against government officials’ abuse of power to advance a political agenda. Threats of donor disclosure will cause harm to organizations like Independent Women; it is crucial that the Supreme Court grant the petition for certiorari and reverse the decision below.”
